Pikker License Agreement

*** PRODUCT OVERVIEW ***

Pikker is a portfolio based technical trading system application, that uses
MetaStock data. Backtest your technical trading system the way you trade --
a portfolio selected from a universe of available securities. Numerous
technical indicators are included (and more in the works), as well as a large
number of mathematical functions, all of which can be combined to create
specific trading rules and screening criteria. Accounts can be loaded, saved,
and edited independently of system rules and settings.
*** SYSTEM REQUIREMENTS ***

Your computer should meet the following system requirements to use Pikker.
* Pentium III 166 MHz or better
* 128 MB memory, 256 MB recommended
* 20 MB disk space
* Windows 95 or later, Windows 2000 Professional recommended
* MetaStock (C) 6.5 or later, with MetaStock data files
*** EVALUATION AND REGISTRATION ***

Pikker is not free software. You may use this software for
evaluation purposes without charge for a period of 30 days. If you use
this software after the 30 day evaluation period, a registration fee is
required. See the download page on the web site,
http://www.emporium-sw.com/download.htm, for detailed information about
registration and purchasing instructions.

*** DISTRIBUTION ***

You may copy the evaluation version of this software and documentation
as you wish, and give exact copies of the original evaluation version
to anyone, and distribute the evaluation version of the software and
documentation in its unmodified form via electronic means. But you
should not charge or request donations for any such copies however
made and from distributing the software and/or documentation with
other products without the author's written permission.
*** REGISTERED VERSION ***

One registered copy of Pikker may either be used by a
single person who uses the software personally on one or more
computers, or installed on a single workstation used non-simultaneously
by multiple people, but not both. You may access the registered
version of Pikker through a network, provided that you have
obtained individual licenses for the software covering all workstations
that will access the software through the network.
*** VERSION NUMBERS AND UPGRADES ***

The version number is indicated on the about dialog. The version number
is of the format M.I.NN, where M is the Major version number, I is the
Intermediate version number, and NN is the miNor version number. For
example, version 1.2.03 is Major version 1, Intermediate Version 2, Minor
version 03. Updates for new versions will be made available from time to
time. Minor version updates will be available for registered users without
fee. Intermediate and Major version updates will require an additional,
nominal registration fee, which goes to support further development. A
history of changes made to updates will be maintained on the web site.
*** BETA TESTERS ***

Registered Beta Testers of Pikker are entitled to use this software
without paying a registration fee. Beta testers are also entitled to
upgrades of minor and intermediate revision changes without registration
fee, but must pay the registration fee for an update of major revision
change. If Beta Testers wish to continue to participate in testing future
major revision updates, the fee for the major revision change will be waived.
*** SUPPORT ***

Support will be provided for users of Pikker via email. Requests for support
should be sent to support@emporium-sw.com. When requesting support, you must
provide your full name, email address, and your customer ID number.
Your registered name and customer ID number can be obtained from the about
dialog from the application. When your support request is recieved, an
incident ID number will be assigned and reported to you. Please use this
incident ID number for further correspondence about that particular issue.
If you have additional questions, please submit a separate request so that
a new incident can be assigned. Before contacting support please check the
following:

1) Review your information. Read relevant portions of the manual, this readme file, and the FAQ (Frequently Asked Questions) file in the directory or at
the web site.

2) Collect your numbers. In addition to your name and customer ID, I need to
know what version you're using. You'll find this number on the About dialog,
from the Help menu. I'll also ask for your processor, operating system, and
their respective version numbers.

3) Isolate your problem to a small test case, if applicable. Short formulas are easier to understand, transmit, and verify on our systems. Be prepared to send
any system files, error log files, and data files that may be relavent to the
problem. Make careful note of any steps that are necessary to reproduce the
problem.
*** FEATURE REQUEST INCENTIVE UPDATES ***

You may request additional features or indicators be included in future updates
to the product. Such requests should be sent by email to
support@emporium-sw.com, with the same requirements outlined under Support
above. If you are the first individual to request a specific indicator or
feature, then when and if that indicator or feature is included, you will be
entitled to have the update fee waived for the next major or intermediate
revision update. If you qualify for the incentive (by being the first individual
to make the request), you will be notified in response to the support incident,
and a note will be made in the support incident. It is then your responsibility
to keep track of the incident ID number, check for the feature in future
updates, and to contact support for further instructions to have the update
fee waived. You can check for changes on the version history section of the
web site. This incentive does not accumulate. You will be qualified for, at
most, one incentive update at a time. After the incentive update is redeemed,
you must make an additional, original request for a feature or indicator to
qualify for any additional incentive update.
*** NO WARRANTY ***

Pikker is sold as is and without any warranty as to
merchantability or fitness for a particular purpose or any other
warranties either expressed or implied. The author will not be liable
for data loss, damages, loss of profits or any other kind of loss while
using or misusing this software. Hypothetical or simulated performance
results have certain inherent limitations. Unlike actual performance
records, simulated results do not represent actual trading. Also, since
the trades have not actually been executed, the results may have under-
or over-compensated for the impact, if any, of certain market factors,
such as lack of liquidity. Simulated trading programs in general are
also subject to the fact that they are designed with the benefit of
hindsight. No representation is being made that any account will, or is
likely to, achieve profits or losses similar to those indicated by this
software.
